1. Definitions

3. Booking Process

3.1 A booking may be made by telephone, email, online form, or in any other manner made available by the Company from time to time.

3.2 At the time of booking, the Customer will be asked to provide details of the location, access arrangements, approximate volume or weight of waste, and any special requirements. The Customer is responsible for ensuring that all information supplied is accurate and complete.

3.3 The Company may provide an estimate based on the information supplied by the Customer. All estimates are given in good faith but are not binding if the actual volume, type, or weight of waste differs from that described by the Customer, or if access and labour requirements are more extensive than advised.

3.4 A Contract is formed when the Customer accepts a quotation, confirms a booking, or allows the Services to commence, whichever occurs first.

4. Access and Customer Responsibilities

4.1 The Customer must ensure that the Company has safe, reasonable, and unobstructed access to the premises and to the waste to be collected at the agreed time.

4.2 The Customer is responsible for obtaining any permissions, permits, or authorisations required for us to access the premises, including where waste is located in communal areas or on third-party land.

4.3 The Customer must ensure that the waste intended for collection is clearly identified and separated from items not to be taken. The Company accepts no responsibility for items removed in error where it was reasonable for the team to assume they formed part of the waste intended for disposal.

4.4 The Customer agrees to provide any necessary information regarding the nature of the waste, including any items that may present a health and safety risk, such as sharp objects, chemicals, or heavy items.

5. Estimates, Quotations, and Pricing

5.1 All quotations and estimates are based on the information supplied by the Customer and on the assumption of normal access and working conditions.

5.2 The Company reserves the right to revise its price if the actual amount or type of waste, the access conditions, or the time required to complete the work differ from what was originally described. Any such revision will be communicated to the Customer before work continues.

5.3 Prices are typically calculated by reference to the volume of waste removed, weight limits, labour time, and any additional surcharges applicable to certain types of waste or challenging access.

5.4 Unless stated otherwise, all prices are quoted in pounds sterling and are exclusive of any applicable taxes or charges that may be required by law.

6. Payments and Invoicing

6.1 Payment is due upon completion of the Services unless otherwise agreed in writing in advance. The Company may, at its discretion, require payment in full or part payment before commencing work.

6.2 The Company accepts payment by cash, card, or other methods notified to the Customer at the time of booking. Where payment is made by card, the Customer authorises the Company to process the agreed charges using the card details provided.

6.3 Where credit terms are agreed for business customers, payment is due within the period stated on the invoice. If no period is stated, payment is due within 14 days of the invoice date.

6.4 If the Customer fails to pay any amount due under the Contract, the Company reserves the right to charge interest on the overdue sum at the statutory rate and to recover any reasonable costs incurred in pursuing the debt.

7. Cancellations and Amendments

7.1 The Customer may cancel or amend a booking by contacting the Company as soon as reasonably possible.

7.2 Cancellations made more than 24 hours before the scheduled arrival time will generally not incur a cancellation fee. However, if the Company has incurred specific costs or reserved specialist resources, a reasonable charge may be applied.

7.3 Cancellations made less than 24 hours before the scheduled arrival time may be subject to a cancellation fee, which may include a call-out charge or a proportion of the quoted price to reflect the time and resources allocated.

7.4 If the Customer is not present at the premises at the agreed time, or if the Company cannot gain safe and reasonable access to the waste, this may be treated as a late cancellation and a fee may be charged.

8. Waste Types and Prohibited Items

8.1 The Company operates in accordance with UK waste regulations and will only collect and transport waste that it is licensed and authorised to handle.

8.2 The Company will not accept hazardous or special waste unless expressly agreed in advance and subject to appropriate licensing, packaging, and pricing. Examples include, but are not limited to, asbestos, certain chemicals, clinical waste, and pressurised containers.

8.3 The Customer must not present any illegal items or materials for collection, including controlled substances or stolen goods. The Company reserves the right to refuse to move any item if there is any concern about its legality or safety.

8.4 If prohibited or undisclosed hazardous items are discovered during the provision of the Services, the Company may suspend or terminate the work and charge the Customer for any reasonable costs incurred.

9. Waste Handling, Disposal, and Recycling

9.1 The Company will handle, transport, and dispose of waste in compliance with applicable UK environmental and waste management laws and regulations.

9.2 Waste is typically transferred to licensed waste transfer stations, recycling facilities, or disposal sites. The Company will endeavour to maximise recycling and recovery of materials where reasonably practicable.

9.3 The Customer agrees that once waste has been collected and loaded onto the Company’s vehicle, ownership of that waste transfers to the Company, except where prohibited by law or by specific agreement.

9.4 The Company may issue a waste transfer note or other documentation as required by law, and the Customer agrees to provide any information and cooperation required for its completion.

10. Liability and Limitations

10.1 The Company will exercise reasonable care and skill in providing the Services. However, the Company shall not be liable for any loss or damage arising from matters beyond its reasonable control, including but not limited to adverse weather, traffic delays, or third-party actions.

10.2 The Customer is responsible for ensuring that areas and items not intended for removal are suitably protected or clearly identified. The Company accepts no liability for minor cosmetic damage that may reasonably occur in the course of removing bulky or awkward items from tight or constrained spaces, provided reasonable care has been taken.

10.3 In the event of proven damage to property caused by the negligence of the Company, the Company’s liability will be limited to the reasonable cost of repair or replacement of the affected item or area, taking into account fair wear and tear and depreciation.

10.4 The Company shall not be liable for any indirect, consequential, or economic loss, including loss of profit, loss of business, or loss of use, arising out of or in connection with the Services or these Terms and Conditions.

10.5 Nothing in these Terms and Conditions shall limit or exclude the Company’s liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law.

11. Customer Indemnity

The Customer agrees to indemnify and hold the Company harmless from and against any claims, losses, damages, costs, or expenses arising from:

a) any breach by the Customer of these Terms and Conditions,

b) any misleading, incomplete, or inaccurate information provided by the Customer, or

c) the presence of hazardous, illegal, or prohibited materials among the waste presented for collection, except where the Company has expressly agreed in writing to handle such materials.

12. Delays and Non-Performance

12.1 The Company will use reasonable efforts to attend the Customer’s premises at the agreed time. However, all arrival times are estimates, and the Company cannot guarantee exact timings due to factors such as traffic, access issues, or unforeseen operational circumstances.

12.2 If the Company is unable to attend at the agreed time, it will endeavour to notify the Customer and arrange an alternative time. The Company shall not be liable for any loss or inconvenience caused by such delay, provided reasonable efforts are made to keep the Customer informed.

12.3 The Company reserves the right to delay, suspend, or cancel the Services where it is unsafe or unlawful to proceed, or where the Customer has failed to comply with these Terms and Conditions.

13. Complaints

13.1 If the Customer is dissatisfied with any aspect of the Services, they should notify the Company as soon as possible, providing full details of the issue.

13.2 The Company will investigate complaints in a fair and timely manner and, where appropriate, may propose remedial action or a goodwill gesture. Any such steps are at the discretion of the Company and without prejudice to its legal rights.

14. Data Protection and Privacy

14.1 The Company may collect and process personal data about the Customer in order to administer bookings, deliver Services, issue invoices, and handle enquiries or complaints.

14.2 The Company will take reasonable steps to ensure that such data is kept secure and is only used for legitimate business purposes or as required by law.

15. Variation of Terms

The Company reserves the right to amend these Terms and Conditions from time to time. Any updated version will apply to new bookings made after the date of publication. For existing Contracts, the version in force at the time of booking will normally apply, unless a variation is agreed in writing between the parties.

16. Severability

If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid or unenforceable, that provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms and Conditions, together with any written quotation or booking confirmation, constitute the entire agreement between the Customer and the Company in relation to the Services and supersede any prior discussions, correspondence, or representations.

18. Governing Law and Jurisdiction

18.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with the provision of Services by the Company, shall be governed by and construed in accordance with the laws of England and Wales.

18.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services.
